Terms of Service

Last updated: 15 June 2026

These Terms of Service ("Terms") govern your use of Gems, an iOS app for sharing and discovering trusted place recommendations. By creating an account or using Gems, you agree to these Terms. If you do not agree, please do not use the app.

1. Who we are

Gems is currently operated by Sune Thomsen, Sundkaj 85, 2150 Copenhagen, Denmark ("we", "us"). You can reach us at hello@joingems.app.

2. Eligibility

You must be at least 13 years old to use Gems. By using the app, you confirm that you meet this requirement and that the information you provide is accurate.

3. Your account

You are responsible for your account and for keeping your login credentials secure. You are responsible for activity that happens under your account. Tell us promptly at hello@joingems.app if you believe your account has been compromised. You can delete your account at any time from within the app.

4. Your content

Gems lets you create and share recommendations, saved places, notes, scores, tags, and photos ("your content"). You keep ownership of your content. By posting it, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, and share it as needed to operate the app and provide the features you use, including showing it to the people you choose to share with. This licence ends when you delete your content or your account, except for copies retained for legal reasons or in others' saved collections where sharing was permitted.

You are responsible for your content. You confirm that you have the right to post it and that it does not infringe anyone else's rights or break the law.

5. Acceptable use

Gems is built on trust. To keep it that way, you agree not to:

We may remove content or suspend accounts that breach these Terms.

6. Recommendations are opinions, not advice

Recommendations on Gems reflect the personal opinions of users. They are shared for general interest and are not professional advice. We do not guarantee that any place, business, or recommendation is accurate, available, safe, or suitable for you. Use your own judgement.

7. Third-party services

Gems relies on third-party services, including Google Firebase and the Google Places API, and integrates with Apple services. Your use of features powered by these services may also be subject to their terms. Place information returned by third parties is provided "as is" and we are not responsible for its accuracy.

8. Our intellectual property

The Gems app, its name, design, and software are owned by us and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or to copy, modify, or distribute the app except as allowed by law.

9. Availability and changes

We are still building Gems and may add, change, or remove features at any time. We may also suspend or discontinue the app. We will try to give reasonable notice of significant changes, but we are not liable for changes or downtime.

10. Termination

You may stop using Gems and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the app. Sections that by their nature should survive termination (such as content licence terms already granted, disclaimers, and liability limits) will survive.

11. Disclaimers

Gems is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or secure.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data, profits, or goodwill arising from your use of Gems. Nothing in these Terms limits liability that cannot be limited under applicable law, including your mandatory rights as a consumer under Danish and EU law.

13. Governing law

These Terms are governed by the laws of Denmark, without regard to conflict-of-law rules. Disputes will be subject to the jurisdiction of the Danish courts, except where mandatory consumer-protection law gives you the right to bring proceedings elsewhere.

14. Apple-specific terms

If you downloaded Gems from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the app or its content. Apple is a third-party beneficiary of these Terms and may enforce them. The app must be used in accordance with the Apple Media Services Terms and Conditions.

15. Changes to these Terms

We may update these Terms as Gems evolves. When we make material changes, we will update the date above and, where appropriate, notify you in the app. Continued use after changes means you accept the updated Terms.
